In a recent win for the Criminal Department at Wainwright & Cummins Solicitors LLP successfully defended a client in the case of R v VB (2025), achieving a complete acquittal on all charges of harassment and breach of a non-molestation order.
The stakes were high as the prosecution alleged that our client had engaged in a year-long campaign of harassment against their ex-partner. Who claims were supported by witness statements, digital communications, and social media activity. A breach of an existing non-molestation order was also alleged, with the Crown painting the picture of a deliberate and persistent course of conduct.
But in court, our defence team dismantled the case. Piece by piece, the prosecution’s case came undone as we proved that the non-molestation order had never been lawfully served on our client. Meaning there was no legal basis for a breach allegation in the first place.
Furthermore, we demonstrated that the prosecution had failed to meet the strict legal definition of harassment. Conduct that may feel upsetting on a personal level, must still meet clear legal thresholds. Including proof of oppressive behaviour and the defendant’s knowledge of wrongdoing.
The case underscores the importance of proper service in breach proceedings and the distinction between conduct that is subjectively distressing and that which meets the legal definition of harassment. It also serves as a reminder that allegations must be supported by clear evidence of both the conduct and the defendant’s awareness of any restraining orders in place.
The judge agreed. The result was a full acquittal. Every single charge dropped as our client walked out of court an innocent person.
