Secure Acquittal in High-Stakes Aggravated Burglary Trial

  • Posted

In another major courtroom victory, the Criminal Department at Wainwright & Cummins Solicitors LLP successfully defended a client in the case of R v TB, securing a full acquittal on charges of aggravated burglary — one of the most serious offences in criminal law.

The allegations were grave. The prosecution claimed our client was part of a group of four men who unlawfully entered a home and threatened the occupants with a knife. Witnesses asserted they had identified our client as being present during the incident, and the case carried the potential for a lengthy custodial sentence.

But during the trial, our defence team meticulously dismantled the prosecution’s case.

We highlighted serious weaknesses in the identification evidence, pointing out inconsistencies in witness accounts and the absence of any forensic proof linking our client to the scene. We challenged the prosecution’s ability to prove active participation in the alleged burglary or any direct involvement in threats made during the incident.

Furthermore, our defence strategy called into question the credibility of key witnesses and demonstrated that the prosecution’s case lacked the strong, corroborative evidence required for such a serious conviction.

After hearing all the evidence, the jury concluded there was reasonable doubt as to our client’s guilt and returned a not guilty verdict on all charges.

This outcome not only delivered justice for our client but also serves as a powerful reminder:
In serious criminal cases, thorough preparation, strategic cross-examination, and relentless advocacy can make the difference between conviction and freedom.

If you are facing serious criminal allegations, you need a defence team that will fight for you every step of the way.
