This trial collapsed as the defence challenged the evidence to the gang-related attempted murder charges-Wainwright & Cummins win another important trial.
Again, the Criminal Department of Wainwright & Cummins Solicitors LLP has shown its ability to bring down even the most intricate criminal prosecutions. In the infamous case of R v MSO, our client was charged with some of the worst offenses in UK law: Section 18 Grievous Bodily Harm with Intent and Attempted Murder.
The prosecution charged that our client and the co-defendants were involved in a violent gang feud. There was a mix of forensics and highly controversial material regarding the case: Drill Music lyrics, supposed gang affiliations, and retrieval of so-called "Zombie Knives" from the crime scene.
In a making case for premeditation and gang rivalry, the Crown tried to cast drill music as evidence for intent, calling an expert witness to interpret lyrics and alleged gang associations. Such a strategy has been repeatedly criticized by the courts on grounds of prejudice, with judges commonly warning against merging artistic expression with criminal behaviour.
Our defence countered vigorously. We examined the entire case against the Crown — regarding witness credibility, validity of gang evidence — with particular emphasis on the fact that one of the defendants received very serious injuries during this incident, thereby raising serious questions as to who actually attacked first and whether the prosecution's version withstood scrutiny at all.
Finally, at the end of our submissions, the Crown Prosecution Service offered no evidence, the case fell apart, and our client was released.
The dramatic outcome embodies two important points:
– The very high legal threshold for proving attempted murder requires clear evidence of intent to kill.
– The dangers of building a case against an accused based on cultural or circumstantial materials — be it music or social media content.
R v MSO is a testament to the firm placing fearless, strategic defence work into action in even the most serious, complex, and politically sensitive corruption cases. When it matters most, Wainwright & Cummins wins.
If you are facing serious or gang-related charges, you need a defence team that fights tooth and nail for you-both inside and outside the courtroom.
